Terms & Conditions

Contained here are the Terms and Conditions which you must read and agree to before your child has their first lesson with The Education Warehouse. When you book with The Education Warehouse, you are agreeing to our Terms and Conditions. These Terms and Conditions may change from time to time.
 

DEFINITIONS

  1. The following expressions are given the following meanings:

    • (a) ‘Booking’ means tuition lessons that are scheduled using the The Education Warehouse website. 

    • (b) ‘Lead Tutor’ means that this Tutor is the only Tutor (and CEO) of The Education Warehouse and has the appropriate qualifications and experience to provide tuition services in the areas advertised on the The Education Warehouse website.

    • (c) ‘Contract’ means the agreement between the Lead Tutor and the parents/guardians of the student for the Lead Tutor to perform tuition services for the student

    • (d) ‘Complaint’ means a claim by a parent/guardian or tutee that the service provided by the Lead Tutor falls below the standards the parent/guardian or tutee expected.

    • (e) ‘Failed Payment’ means an outstanding Lesson Fee, for which The Education Warehouse has been unable to make a successful charge against the payment details provided by the parent/guardian.

    • (f) ‘Lesson Fee’ is the hourly fee.

    • (g) ‘Student’ means the child that partakes in the tutoring lessons via The Education Warehouse. 

    • (h) ‘The Education Warehouse website’ means the website operated by The Education Warehouse.

  2. In these Terms:

    • (a) words importing the singular shall include the plural and vice versa; and

    • (b) words importing the masculine gender shall include the feminine gender and vice versa.​

 

GENERAL

  1. All business undertaken by The Education Warehouse, the Lead Tutor and the student’s parent/guardian is transacted subject to these Terms. In the event of any conflict between these Terms and any other terms and conditions, these Terms shall prevail. 

OBLIGATIONS OF THE EDUCATION WAREHOUSE AND RELATED PROVISIONS

  1. The Education Warehouse website has been established to allow parents/guardians to contact the Lead Tutor regarding tutoring services. The Education Warehouse website also allows parents/guardians to book lessons with the Lead Tutor.

  2. The Education Warehouse will take precautions it considers appropriate to keep the details of parents/guardians and a tutee secure but will not be liable for unauthorised access to the information provided by a parent/guardian or tutee on the The Education Warehouse website.

LEAD TUTOR - DUTIES

  1. The Lead Tutor warrants that -

    • (a) she is of at least eighteen years of age;

    • (b) she has the necessary qualifications and/or experience to provide tuition in the subjects specified on the The Education Warehouse website;

    • (c) her profile and subject information provided on the The Education Warehouse website is up to date, accurate and truthful; and

    • (d) she has the legal right to work in the UK on a self-employed basis.

  2. The Lead Tutor has not received any criminal convictions or cautions.

  3. The Lead Tutor will never contact a student without the consent of the parent/guardian, and this will only be via educational platforms, for example, ‘Show My Homework' or 'Google Drive.'

  4. The Lead Tutor is responsible for the prices quoted for the services on the The Education Warehouse website.

  5. The Lead Tutor is responsible for collection of all fees due to her from parents/guardians. 

  6. The Lead Tutor will not complete on behalf of the student any coursework, essays, or other assignments.

  7. The Lead Tutor will not request any upfront fees, except for a deposit which is equal to one Lesson Fee. The Lead Tutor will only accept payment for a block booking at a time (an academic term – approximately 12-15 weeks), to be paid before the start of each academic term; this includes pro-rata bookings.

LEAD TUTOR - ADDITIONAL DUTIES

  1. The Lead Tutor must not make any agreement with either a student or any member of the student's family or the student's parent/guardian which is intended to circumvent the relationship between The Education Warehouse and the student and to benefit the Lead Tutor at The Education Warehouse 

  2. If the Lead Tutor fails to deliver to a standard expected by a student or parent/guardian, the Lead Tutor will be liable to refund the parent/guardian the entire Lesson Fee for the associated lesson.

  3. The Lead Tutor must allow at least 15 minutes from the scheduled start time of a lesson for the student/s to attend the lesson. If the Lead Tutor fails to do so, the Lead Tutor will be liable to refund the student/s the entire Lesson Fee for the associated lesson.

  4. If the Lead Tutor is late due to extenuating circumstances, she will communicate with you by email or by telephone as soon as is reasonably practicable. If the lateness is over 5-minutes, the amount of minutes late will be pro-rated and refunded to the account that you made your termly payment with, unless the Lead Tutor and the parent/guardian can come to a mutual agreement in regards to making up the time lost to the student.

STUDENT DUTIES

  1. A student must not publish any abusive comments about the Lead Tutor or another student on the The Education Warehouse website or any other place. This include defamatory or derogatory comments.

  2. The Education Warehouse is not responsible for examination entry; this is the sole responsibility of the student and the parent/guardian.

  3. A student must not request the Lead Tutor to complete coursework, essays, or other assignments for them. 

  4. Lessons will start at their scheduled time. If a student is late without prior warning from the parent/guardian, the time will not be made up. If the student does not arrive within 15 minutes of the start time of the lesson, it is up to the Lead Tutor’s discretion if they wish to cancel the individual lesson or delay student entry to a grouped lesson, if it will disrupt the teaching and learning. The Lesson Fee will not be refunded.

  5. Students in both grouped and individual lessons are expected to behave in a positive and appropriate manner at all times, similar to how they are expected to in school/educational environments. They must not distract other students during the lesson. Failure to behave in a responsible manner will result in warnings. The student will not be allowed to participate in any future lessons if they reach three warnings per lesson for two lessons maximum in one academic term (i.e. distracting others, silly behaviour, talking excessively and anything that the Lead Tutor deems of this nature etc.). If the student's behaviour is considered more serious by the Lead Tutor (i.e. swearing, derogatory language, bullying, cheating and anything that the Lead Tutor deems of this nature etc.), it is up to the Lead Tutor's discretion if they wish to terminate the student's scheduled lessons with The Education Warehouse altogether - this can apply to serious behaviours happening on just one occasion. A refund will not be issued for the lessons that parents/guardians have paid for in advance. 


PARENT/GUARDIAN DUTIES

  1. The parent/guardian is responsible for verifying the credentials, expertise, references, DBS checks and qualifications of the Lead Tutor with whom he enters into or proposes to enter into a Contract.

  2. Lessons will start at their scheduled time. If a student is late without prior warning from the parent/guardian, the time will not be made up. If the student does not arrive within 15 minutes of the start time of the lesson, it is up to the Lead Tutor’s discretion if they wish to cancel the individual lesson or deny the student entry to a grouped lesson, if it will disrupt the learning and teaching. The Lesson Fee will not be refunded.

  3. The Education Warehouse is not responsible for examination entry; this is the sole responsibility of the student and the parent/guardian.

  4. When a Booking is confirmed, a parent/guardian enters directly into a contract with The Education Warehouse for the provision of lessons.

  5. Once a parent/guardian has been given confirmation of their child’s place by The Education Warehouse, they will be given a deadline to make payment via a Stripe invoice. Failure to make payment on time may result in your child losing their place. The first day of a late payment for deposits or monthly payments will cost £30.00. In addition, further late payments will cost £10.00 daily (a maximum of three days only after the initial £30.00 late payment) until the deposit or monthly payment is made. If the late payment/late payment plus additional late fees are not paid, your child’s future lessons may be terminated.

  6. When a confirmed Booking exists, the parent/guardian must ensure that he has a valid debit/credit card with sufficient funds to cover the Booking. Unsuccessful payments (after 72 hours from the booking time and date) may result in your child losing their place.

  7. In the case of a Failed Payment still being outstanding 72 hours after the time and date of the booking, parents/guardians authorise The Education Warehouse to automatically retry the charge.

  8. If a parent/guardian has an outstanding Failed Payment for over 96 hours then all future lessons will be cancelled.

  9. Parents/guardians must not use the The Education Warehouse website for illegal, unlawful or prohibited purposes. This includes sending or posting junk e-mail or spam, publishing misleading, defamatory, indecent, obscene or advertising material, or send viruses and worms.

  10. Parents/guardians must not impersonate any other person or entity or to use a false name or a name that they have no authority to use.

  11. Parents/guardians must not post material to the The Education Warehouse website in which the copyright or intellectual property is or may be the property of another person or body.

  12. Parents/guardians agree to manage their charges using The Education Warehouse website (via Stripe). If a parent/guardian cancels their payment, they will not receive a refund of any fees already paid.

  13. If a parent/guardian makes payment for an academic term without confirmation of a student’s place from The Education Warehouse, they may be refunded the amount, minus the Stripe fees (business fees incurred).

  14. The Education Warehouse reserves the right to accept or refuse payment. Parents/guardians must not transfer or assign their payment or any other plan to another parent/guardian. 

  15. Parents/guardians should inform The Education Warehouse of a complaint by email (ebony@theeducationwarehouse.com) within 48 hours of the scheduled finish time of the relevant lesson. The Lesson Lee will still be chargeable and The Education Warehouse will hold the payment until the dispute is resolved.


CANCELLATIONS

  1. Lessons are booked in advance on a monthly (every 4 weeks) or termly basis (approximately 12-15 weeks). If you wish to terminate the attendance of your child altogether after making a payment, you will not receive a refund for the lessons you have paid for in advance, unless by mutual agreement due to extenuating circumstances. 

  2. If you wish to cancel a single lesson or more than a single lesson, you will not receive a refund for the lessons you have paid for in advance, unless by mutual agreement due to extenuating circumstances. If there is a date in the future that clashes with the day/time of your child's time-slot, please let The Education Warehouse know before making payment.

  3. Cancellation due to student illness must be made as soon as possible (according to the circumstances). The opportunity for a session at a mutually convenient alternative slot (individual lessons only) may be arranged, though you must accept that it may not always be possible to accommodate the rescheduling of lessons, in which case the lesson will be missed and the single lesson fee will be refunded. Please endeavour to inform The Education Warehouse as soon as possible if your child cannot attend a lesson due to illness.

  4. Cancellation due to tutor illness will be made as soon as possible (according to the circumstances). The opportunity for a session at a mutually convenient alternative slot (both individual and grouped) may be arranged, though you must accept that it may not always be possible to accommodate the rescheduling of lessons, in which case the lesson will not take place and the single lesson fee will be refunded. The Lead Tutor will endeavour to inform you as soon as possible if she is ill and cannot teach a lesson.


INTELLECTUAL PROPERTY

  1. The code, brand and intellectual property of the The Education Warehouse website cannot be reused without The Education Warehouse’s consent. All copyright, trademarks, and other intellectual property rights in and relating to The Education Warehouse website are owned by The Education Warehouse. It is prohibited to copy, distribute, show in public or create any derivative work from the The Education Warehouse website, or any of the material which is found on the The Education Warehouse website without the consent of The Education Warehouse. Please see our Copyright Notice, which forms part of these Terms and Conditions.


MISCELLANEOUS PROVISIONS

  1. The Education Warehouse reserves the right to withdraw or modify aspects of the The Education Warehouse website, or the entirety of it.

  2. The Education Warehouse may, at their sole discretion, vary the features of the The Education Warehouse website and the Terms of use at anytime.

  3. The Education Warehouse may monitor postings to the The Education Warehouse website and communications through The Education Warehouse website and have the right to delete and/or block such postings or communications at their sole discretion.

  4. The Education Warehouse give no guarantee that the The Education Warehouse website is free of viruses, worms or any other form of harmful components.

  5. The Education Warehouse may contact parents/guardians by the details we have stored on their account; this could include by email and phone. 

  6. The Education Warehouse may use data for statistical analysis. We will not provide this to interested third parties.

  7. PRIVACY POLICY (which can be found at the bottom of the The Education Warehouse home page): The Education Warehouse's Privacy Policy forms part of these Terms and Conditions, and by agreeing to these Terms and Conditions, you also give your consent to the way we may handle your personal data as detailed in that policy. Given the global nature of the World Wide Web, any posting on The Education Warehouse website (including any which contain personal information) is, of course, accessible to internet users around the world.

  8. SEVERABILITY: In the event that any term of these Terms and Conditions is held to be invalid or unenforceable by judicial decree or decision, the remainder of these Terms and Conditions shall remain valid and enforceable.

  9. English Law and the jurisdiction of English Courts applies to these terms.
